Figuring Out Who Pays for Car Damage After an Accident

You get into a non-fatal car accident, thankfully. With both parties from both vehicles relatively unscathed there is only one problem now that remains. Who foots the bill? This depends largely on who is at fault and who has (or doesn’t have) insurance.

If Another Driver Caused the Accident

If another driver caused the accident, he/she is liable for the damages on your vehicle. If that is the case, the insurance company will have to determine if it the person they insured (the other driver) is really at fault. All you will have to do is pay the deductible and your insurance company will cover everything else.

  • None of You Have Insurance

Well, this basically means you’re screwed. Just kidding, you’re only a little screwed. You and the other driver could settle this among-st yourselves, hopefully he/she will offer to shoulder the expense or at least split it. If the other driver doesn’t want to pay up you can press charges. Then again, if the other driver has no means of paying you back, you’re still going to end up paying for your repairs regardless.
